Kubby attorney and evasive DA square off in Placer County

Steve KubbyPlacer County prosecutors fraudulently obtained an appellate court ruling that would have sent him to prison and a certain death, medical-marijuana activist Steve Kubby charged in a brief seeking to overturn his 2000 conviction.

A hearing to reconsider Kubby’s motion challenging the search warrant that led to his Jan. 19, 1999, arrest is scheduled for 11 a.m. next Monday in Courtroom 10, located in Placer County’s DeWitt Center.

“The whole strategy was to get me behind bars, where I would die,” Kubby said this week. “Once I became a felon, [Judge John] Cosgrove was supposed to re-sentence me as a felon. Typically that would have meant some jail time. Doctors aren’t the only ones who can bury their mistakes. They thought they could bury me.”

We Have Enough Roads

Eminent domain is making news lately with the “Kelo” Supreme Court decision. 

Most people think road construction is a legitimate use of eminent domain, but in most cases these days, new or bigger roads subsidize the cost of building new housing developments.  That makes it more profitable for the developer and cheaper for the new homeowner at the expense of the original owner of the land which was taken for the road.  The bottom line is that private land is taken for the profit of very few private parties (the developer and possibly the developer’s clients).

 
When you read simple rhymes every night before bed
To little ones hanging on every word said,
Simple ideas get awfully clear,
Notions that most people hold very dear,
Like rights to liberty, property, life.
To keep them takes vigilance, courage, and strife.
 
I know how the Lorax felt stating his case,
For the fish and the birds and the trees on his place.
He argued and argued for things that were right
While the Once-ler went on making blight after blight.
